# Should you settle or litigate your crypto dispute?

The better route depends on what you need to obtain and what evidence can support it. Settlement can preserve a commercial relationship or create a payment plan. Proceedings may be needed when assets are at risk, facts are disputed, a counterparty will not engage or an enforceable order is required.

## What should drive the choice?

| Question | Why it matters |
| --- | --- |
| Are assets or records at immediate risk? | Urgent relief may require a court or tribunal with power over the relevant person or asset. |
| Is the counterparty willing and able to perform? | A settlement is useful only if performance and enforcement are realistic. |
| What does the contract say? | Governing law, jurisdiction and arbitration clauses may control the forum. |
| Can the claim be proved? | Preserve agreements, representations, wallet and exchange records, and the valuation method before negotiating. |
| Where would an order be enforced? | A judgment or award still needs a route to assets in the target jurisdiction. |

Do not assume that a crypto asset is valued at the enforcement date. The contract, cause of action, remedy and applicable law control the valuation question. A claimed “universal 2024 crypto judgment” does not establish one rule for every dispute.

## Is mediation confidential or privileged?

The answer depends on the process and forum. The UAE has a [federal mediation and conciliation law](https://uaelegislation.gov.ae/en/legislations/2121/download), and a separate [federal arbitration law](https://uaelegislation.gov.ae/en/legislations/1069/download). They do not make every informal settlement message automatically privileged or inadmissible. Marking an email “without prejudice” is not a substitute for assessing the applicable law and circumstances.

## What does the process cost?

A court’s published filing schedule is only one component. The [DIFC Courts fee page](https://www.difccourts.ae/about/fees) helps estimate that component for an eligible claim; it does not provide a universal budget for lawyers, experts, tracing, enforcement or time. Ask for a staged budget tied to the actual forum and issues.

If settlement is possible, write the obligations clearly: asset and currency, wallet or account, timing, release conditions, default, evidence of performance, confidentiality where lawful, and the forum for enforcing the agreement.
