Choose the correct court, arbitration process or regulator after checking the contract, parties, governing law and remedy needed.

A crypto dispute does not automatically belong in a specialist “crypto court”. The contract, parties, place of business, governing law, jurisdiction clause and remedy determine the route. VARA regulates virtual-asset activity in Dubai outside DIFC; it is **not a court**.

## Which forum can hear the claim?

- **DIFC Courts:** the [Digital Economy Court rules](https://www.difccourts.ae/rules-decisions/rules/part-58) provide procedure for qualifying digital-economy claims. Jurisdiction still has to be established.
- **ADGM Courts:** the [ADGM Courts](https://www.adgm.com/adgm-courts) hear matters within their jurisdiction and apply ADGM’s legal framework, which incorporates English common law. The fact that a transaction used a blockchain does not itself select ADGM.
- **Onshore UAE courts or arbitration:** the contract and applicable law may point here. An arbitration clause can require a different route from a court claim.
- **VARA:** its [complaints rules](https://rulebooks.vara.ae/rulebook/complaints-handling-requirements) concern licensed VASPs’ handling of client complaints. A regulatory complaint is not a substitute for a private damages claim or an asset-freezing order.

## What can a court decide about a token?

First identify the asset and the right claimed: title, a contractual payment, a trust interest, an account balance or compensation for wrongdoing. The [DIFC Digital Assets Law](https://www.difc.com/business/laws-and-regulations/legal-database/difc-laws/digital-assets-law-difc-law-no-2-of-2024) supplies a DIFC statutory framework; it does not settle every UAE-law question. Control of a private key may be important evidence, but it is not a universal ownership test.

The *Gate Mena v Tabarak* litigation shows why procedural history matters: the [DIFC appeal](https://www.difccourts.ae/rules-decisions/judgments-orders/court-appeal/1-gate-mena-dmcc-formerly-known-huobi-otc-dmcc-2-huobi-mena-fze-v-1-tabarak-investment-capital-limited-2-christian-thurner-2023) was followed by a [retrial decision](https://www.difccourts.ae/rules-decisions/judgments-orders/digital-economy-court/1-gate-mena-dmcc-formerly-known-huobi-otc-dmcc-2-huobi-mena-fze-v-tabarak-investment-capital-limited-2024-difc-dec-002). Do not cite an early ruling as the final outcome.

## What should you do first?

Preserve the agreements, communications, wallet addresses, exchange records and transaction hashes. Identify who can still move the assets. Then assess jurisdiction, urgent relief, service and enforceability in each place where assets or defendants are located. [DIFC Courts publish filing fees](https://www.difccourts.ae/about/fees), but those are not a prediction of total legal costs or recovery odds.

- [DIFC Courts, Digital Economy Court rules](https://www.difccourts.ae/rules-decisions/rules/part-58) and [DIFC Digital Assets Law](https://www.difc.com/business/laws-and-regulations/legal-database/difc-laws/digital-assets-law-difc-law-no-2-of-2024): DIFC procedure and substantive law have distinct roles.
- [ADGM Courts](https://www.adgm.com/adgm-courts): ADGM forum and legal-system context.
- [VARA complaints requirements](https://rulebooks.vara.ae/rulebook/complaints-handling-requirements): regulatory client-complaint process, not a court.
- [*Gate Mena* appeal](https://www.difccourts.ae/rules-decisions/judgments-orders/court-appeal/1-gate-mena-dmcc-formerly-known-huobi-otc-dmcc-2-huobi-mena-fze-v-1-tabarak-investment-capital-limited-2-christian-thurner-2023) and [retrial](https://www.difccourts.ae/rules-decisions/judgments-orders/digital-economy-court/1-gate-mena-dmcc-formerly-known-huobi-otc-dmcc-2-huobi-mena-fze-v-tabarak-investment-capital-limited-2024-difc-dec-002): read together before describing the outcome.
